This case was scheduled to be brought on for hearing before the Kentucky Alcoholic Beverage Control Board on February 2, 2005, pursuant to an order directing the Licensee to show cause, if any it could, why its alcoholic beverage licenses should not be suspended or revoked because of alleged violations of: (1) KRS 244.080(1), Sale to a Minor; and, (2) KRS 243.390, Bad Corporate Standing.
Prior to a hearing being held, the Licensee, through its President, Mr. Anthony Johnson, admitted the violations by letter dated January 31, 2005. The Board takes administrative notice that the Licensee had a prior violation of KRS 244.080(1) within a two (2) year period.[1] The Board takes administrative notice of the fact that the Licensee has corrected its standing with the Office of the Secretary of State of Kentucky.
Based upon the admission and the record herein, and being otherwise sufficiently advised, the Board finds the facts to be as set out in the Show Cause Order.
IT IS, THEREFORE, ORDERED that:
1. Charge 2 is dismissed.
2. Retail Beer License No. 037-B-6542 and Retail Drink Liquor License No. 037-LD-1551 are suspended for a period of fifty (50) days.
3. The Licensee shall not sell, serve or deliver any alcoholic beverages during the first thirty (30) suspension days. The thirty (30) day suspension shall begin at the opening of business at 6:00 o’clock a.m. on Saturday, April 9, 2005, and shall end at the opening of business at 6:00 o’clock a.m. on Saturday, May 14, 2005.
4. The remaining twenty (20) suspension days shall be conditionally discharged (probated) for one (1) year upon the conditions that the Licensee: (1) shall train all current employees, whether full- or part-time, who are involved in the handling, serving, or selling of alcoholic beverages, through the Office’s STAR program, within the thirty (30) suspension days set out in Section 3 of this Agreed Final Order; (2) shall train all employees, whether full- or part-time, hired during the one (1) year probationary period herein who are involved in the handling, serving or selling of alcoholic beverages, through the Office’s STAR program, within sixty (60) days of their date of hire; and, (3) shall have no further violations of the alcoholic beverage laws for a period of one (1) year from the date of this Agreed Final Order.
5. The Licensee shall immediately send a written list of all current employees to the Office’s Education Branch at 1003 Twilight Trail, Frankfort, KY 40601. The Licensee shall further contact the Office’s Education Branch at (502) 564-4850 to arrange for the listed employees’ STAR training. All listed employees must successfully complete STAR training, on or before Wednesday, April 13, 2005.
6. If the Licensee fails to comply with the terms of conditional discharge (probation) contained in paragraph 4 hereinabove, the twenty (20) remaining suspension days shall be served and shall begin at the opening of business at 6:00 o’clock a.m. on Thursday, April 14, 2005, and shall end at the opening of business at 6:00 o’clock a.m. on Saturday, May 7, 2005.
Licensee has voluntarily waived its right to appeal and has agreed to begin serving its suspension of license effective the date of entry of this Order.
